Child Custody & Visitation

What exactly is a Separation Agreement?

We understand that child custody is a very sensitive and emotionally charged issue. At Leonard A. Rosner Attorney at Law, we will take into account the family dynamic, habits, and past behavior in order to work with the laws to create a custody plan that is designed with your best interests and that of your child in mind. We even offer legal counsel to clients that have divorced and now live in another state than their child.

Attorney, Leonard Rosner has extensive experience and is highly skilled in representing clients in complex custody matters. It is very important to retain an attorney as quickly as possible when custody is involved since the initial determination of a temporary custody arrangement is vital. Ultimately all custodial arrangements or decisions are made in the best interest of the child and by or with the approval of the court.

Once legal proceedings have been commenced, an attorney will be assigned by the judge to represent your child. The Attorney for the Child (formally called a law guardian) will be your child's advocate. Mr. Rosner, who has significant experience as a law guardian, will use that experience to assist you.

In New York State there are a variety of options involving custody and decision-making:

  • Joint custody: Both parents have a voice in decision-making with their child, though one parent may have more time with the child than the other.
  • Sole custody: Granted to one parent with the other parent having specific, enforceable periods of residency but limited decision-making input.
  • Shared custody: Usually a 50/50 residency; the possibility when parents agree on how to divide residency and decision-making; cooperation is a must.
  • Split custody: Involves more than one child; where one child’s primary residence is with one parent while the other child’s primary residence is with the other parent; this is unusual but does occur.

Grandparent Custody and Visitation:

New York law provides limited rights to grandparents when it comes to custody and visitation involving their grandchildren. There are critical issues that must be addressed prior to the commencement of any litigation. This is why it is extremely important to seek the services of attorney Leonard Rosner who has extensive experience in this difficult and stressful area of the law.
